1. Introduction

These Terms and Conditions (“Terms”) govern the provision of services by [Moxley Property Group] (“we”, “us”, or “our”) and apply to all clients (“you”, “the Client”) who engage with our website or services.

By accessing our website or instructing us to provide services, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Nature of Services

We provide bespoke property deal sourcing services only. Our role is strictly limited to identifying and introducing potential property investment opportunities and providing information relating to those opportunities.

We act solely as an introducer. We do not act as an estate agent, financial adviser, solicitor, surveyor, or investment adviser, and nothing on our website or within our services constitutes regulated advice.

3. No Agency Relationship

Nothing in these Terms creates a partnership, joint venture, or agency relationship between us and the Client, or between us and any vendor or third party. You acknowledge that we have no authority to act on your behalf or bind you to any transaction.

4. Client Responsibilities

You acknowledge and agree that:

  • You are responsible for carrying out your own due diligence in respect of any property introduced to you.

  • You must take independent legal, financial, tax, and surveying advice before proceeding with any transaction.

  • You are responsible for ensuring you have sufficient funds to proceed with any property purchase and to pay all associated fees.

  • Any decision to proceed with a property transaction is made solely at your own discretion and risk.

 

5. Accuracy of Information

While we will act in good faith and make reasonable efforts to provide accurate information, we do not warrant or guarantee the accuracy, completeness, or suitability of any information provided. Property information is often sourced from third parties, and we accept no liability for errors or omissions.

6. Fees and Payment

A finder’s fee is payable for our services, as agreed prior to commencement. Unless otherwise stated:

  • Fees are payable in advance on engagement.

  • All fees are exclusive of VAT (where applicable).

  • Payment must be made in full before any deal information is released.

 

7. Refunds and Cooling-Off Period

(See Refund Policy Page Separately)

Where applicable, clients may request a refund within 14 days of engagement, provided that no steps have been taken to acquire the property and the sourced deal has not been used, disclosed, or acted upon in any way.

If a refund is requested but it is subsequently identified that the Client has engaged with the property, vendor, agent, or third parties, the right to a refund will be withdrawn. Where a refund has already been issued in such circumstances, the refunded amount must be repaid in full upon request.

Outside of the cooling-off period, all fees are non-refundable, reflecting the bespoke nature of the services provided.

8. Confidentiality

All information provided to you in connection with a sourced deal is confidential. You agree not to disclose, share, or distribute any deal information to third parties without our prior written consent.

This obligation continues even if our engagement ends.

9. Limitation of Liability

Nothing in these Terms limits liability for fraud or any matter which cannot lawfully be excluded.

Subject to this:

  • We shall not be liable for indirect or consequential losses, loss of profit, loss of opportunity, or loss of anticipated savings.

  • Our total liability arising out of or in connection with our services shall not exceed the amount of the finder’s fee paid.

 

10. Compliance and Due Diligence

You agree to comply with all applicable laws and regulations. We reserve the right to request identity verification and compliance information in accordance with anti-money laundering regulations. Failure to provide such information may result in termination of services.

11. Termination

We reserve the right to terminate our services immediately if:

  • You breach these Terms;

  • You provide misleading or incomplete information;

  • You fail to comply with legal or compliance requirements.

Termination does not affect any accrued rights or obligations.

12. Intellectual Property

All content on our website, including text, branding, and materials provided as part of our services, remains our intellectual property and must not be copied or reproduced without permission.

13. Website Use

You agree not to misuse our website, interfere with its operation, or attempt unauthorised access. We do not guarantee uninterrupted access to the website and may update or withdraw content at any time.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or our services.
